§ 1 Scope
(1) These General Terms and Conditions apply both to entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB) and to consumers within the meaning of Section 13 of the German Civil Code (BGB).
(2) A consumer is any natural person who concludes a legal transaction for purposes which can predominantly be attributed neither to his commercial nor to his independent professional activity.
(3) An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity. The special provisions applicable to consumers are marked separately in each case.
§ 2 Conclusion of Contract

When ordering in this online shop, you submit a binding offer by submitting the order. Receipt of your order will be confirmed to you by email. The contract is only concluded upon subsequent order confirmation.
If you order by telephone, you will also receive an order confirmation by email, which concludes the contract.
§ 3 Right of withdrawal for consumers
The following cancellation policy is aimed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB). According to this, a consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to either their commercial or their independent professional activity.
Please note that you have no right of withdrawal for contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.
consequences of revocation
If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

to send or hand over the goods. This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.
§ 4 Delivery, Shipping, Transfer of Risk
(1) The freight and shipping costs shall be borne by the buyer.
(2) When the goods are dispatched to the buyer, the risk shall pass to entrepreneurs when the goods are handed over to the transport company and to consumers when the goods are handed over by the transport company to the buyer.
(3) The goods will be handed over to the parcel service no later than 2 days after receipt of payment, or in the case of customer-specific items no later than 10 days after receipt of payment.
(4) If the delivery date is delayed despite careful selection and conclusion of appropriate contracts for reasons for which we are not responsible, the delivery time shall be extended accordingly. The buyer will be informed of this immediately.
If the delay in delivery lasts longer than four weeks since receipt of the customer's order, both parties are entitled to withdraw from the contract, excluding any claims for damages.
(5) If performance by us is impossible without us being responsible for the non-delivery, e.g. due to force majeure, the buyer's claim to performance shall lapse.
§ 5 Warranty
(1) The statutory liability for defects applies.
(2) The warranty period for consumers for new items is two years from delivery of the goods. For used items, the warranty period is one year from delivery of the goods. The warranty period for entrepreneurs is one year from delivery of the goods. The shortened one-year warranty period does not apply if we are

(3) Irrespective of the above points, we are not liable for the customer's claims for damages, e.g. due to non-performance, negligence when concluding the contract, breach of ancillary contractual obligations, consequential damages, damages from tort and other legal reasons, unless we are liable due to the lack of a guaranteed property or due to intent or gross negligence. Regardless of the degree of our negligence, any liability in the event of fraudulent concealment of a defect remains unaffected. This exclusion of liability also does not apply to claims under the Product Liability Act.
§ 6 Data storage
The seller's offer page is stored by eBay for up to 90 days after the contract has been concluded and can be viewed by the customer under the respective item number. The customer has the option of printing out the website using the browser's print function.
§ 7 Data Protection
(1) We would like to point out that we will save the buyer's name, address and all other order-related data in order to process his order. The buyer agrees to this. We will save and process the buyer's personal data in compliance with the applicable data protection regulations.
(2) We only collect personal data if and to the extent that it is made available to us by the buyers themselves with their knowledge. In particular, this personal data will only be used for advertising/market research purposes and to design our services if the buyer has given us their express consent to do so.
(3) The buyer has the right to revoke the consent given at any time. In the event of a corresponding notification, the personal data stored about the person will be deleted unless the data in question is still required to process the contractual relationship or legal regulations prevent deletion.
(4) The purposes of processing are stated at the relevant points on our websites and are not subject to subsequent change.
Data will only be passed on to third parties without your consent if we are legally obliged to do so.
(5) The buyer has the right to receive information about the data stored about him at any time, including the origin and recipient of the data and the purpose of the data processing. The data stored about him will also be deleted at the buyer's request, provided that the corresponding data is no longer required for the execution of the contractual relationship or a legal requirement for deletion

§ 8 Contract language, place of jurisdiction, applicable law
(1) The contract language is German.
(2) The legal relationship between us and the purchaser/customer shall be governed by the law of the Federal Republic of Germany, unless this violates mandatory domestic law of the purchaser.
(3) For all current and future claims arising from this business relationship with merchants, legal entities under public law or special funds under public law, including bills of exchange and check claims, the place of jurisdiction is that of the seller. The same place of jurisdiction applies if the buyer has no general place of jurisdiction in the country, moves his place of residence or habitual abode out of the country after conclusion of the contract or his place of residence or habitual abode is not known at the time the action is brought. In all other cases, the place of jurisdiction for claims of the seller against the buyer is the buyer's place of residence.
Information obligation according to Section 18 of the Battery Act (BattG)
Make sure that you hand in your old batteries/rechargeable batteries, as required by law, at a municipal collection point or at a local retailer. Disposal in normal household waste is prohibited and violates the Battery Act. The disposal is free of charge for you. You are also welcome to return the batteries/rechargeable batteries purchased from us to us free of charge after use. The batteries/rechargeable batteries must always be returned to us with sufficient postage. Returns of batteries/rechargeable batteries should be addressed to:

Batteries and rechargeable batteries that contain harmful substances are clearly marked with the symbol of a crossed-out garbage can. The chemical name of the relevant harmful substances can also be found under the symbol of the crossed-out garbage can. Examples of this are: (Pb) lead, (Cd) cadmium, (Hg) mercury. You can also read this information again in the documents accompanying the delivery of goods or in the operating instructions of the respective manufacturer.
